Public procurement.

A public contract, in the legal system of a State, is a contract for pecuniary interest entered into in writing between one or more economic operators and one or more contracting authorities having as its object the execution of works, the supply of products or the provision of services pursuant to Directive 2004/18/CE of 31 March 2004.

Urban Planning

The operational tools of urban planning are the so-called urban planning tools, which can be distinguished by hierarchical level, typology and functionality. In Italy they start with the promulgation of law n.1150 of 17 August 1942. Its urban planning is hierarchically ordered on three levels: regional (territorial plans), provincial (supra-municipal plans) and municipal (general regulatory plans or PRG). Of these, the one that has received widespread application is the municipal one (PRG). Law 1150/1942, which is moving on a national scale, has been waiting for a reform for some time, which for now cannot be approved. Vice versa, from 1942 to date numerous supporting laws have been promulgated for specific topics (public housing, Standard, etc.) which however have not changed its framework role. Of these we can recall, respectively, the following laws: 167/1962; 765/67; 865/71; 10/77; 142/90. Furthermore, with the advent of the Government of the Regions in 1972 [2], the building and land sector passes from a central management to the regional one, and in fact each Region begins to adopt its own regulations for the various construction sectors , urban planning and the territory. Over time, other issues have also appeared in the debate of the government of cities and the territory in general that were not originally a priority under Law 1150/1942, defined as the National Urban Planning Law (LUN). These issues refer mainly, but not only, to the sectors of landscape protection and environmental protection, which receive an increasingly important impulse and which is summarized in the approach to sustainability. The main types of urban planning instruments, generated by the LUN (1150/1942) and by the other laws just mentioned, are summarized below. In particular, the Country Plans derive both from law n. 1497 of 1939, therefore prior to 1150 of 1942 both of the so-called Galasso decree and related galaxies (each for each Region) which became Law 431 of 8 August 1985.

Public Competitions

The competition mechanism is aimed at guaranteeing equal access to the positions for which the selection takes place, through an objective assessment of the ability to carry out the related tasks and, therefore, on an exclusively merit-based basis, avoiding that the choice is influenced by patronage practices. , recommendations, nepotisms, logic of political affiliation or favoritism of various kinds.
The procedure differs according to the context, a simple question without any formalities or a more complex procedure may suffice. When the competition is compulsory, the procedures are governed, at least in the main aspects, by the law. When, on the other hand, recourse to it is a free choice of the entity, it is the same who sets the rules for its development. In this case, the typical phases of the conduct of a competition are provided for by the issuing act. The assignment of places to the winners of the competition can be formalized with the stipulation of a contract or with an appointment deed. Sometimes the outcome of the competition does not completely bind the appointment: this happens when it is foreseen that, instead of a ranking, only a list of suitable candidates is formed, among which those to be nominated can be chosen at the discretion.

Environment

Contractual liability is the liability that derives from the non-fulfillment, from the incorrect fulfillment and from the late fulfillment of a pre-existing obligation whatever the source (with the exception of the unlawful fact) and is distinguished from the non-contractual liability that derives from the violation of the generic obligation to not to harm anyone without identifying an obligation before the violation.

The third book of the civil code, "on property", is dedicated more generally to real rights, that is, to the rights that man can exercise over susceptible goods that are within his sphere of control or exercise. Goods are normally the subject of this right. The real rights of guarantee are instead pledge, mortgage and special privilege, and are used to provide a guarantee for a credit: the creditor holding the guarantee right will thus be able to preferentially satisfy the asset object of the right.

These protections, those of creditors, however, are not governed exclusively in the Civil Code, in fact also the Code of Civil Procedure contains a large part of them and above all rules of an executive nature. The matter of the protection of rights, and in particular of patrimonial ones, is so vast and difficult that the Criminal Code configures certain offenses harmful to such rights also as crimes, providing for serious sanctions (e.g. bankruptcy, fraudulent insolvency, etc.).
